SCANDINAVIA, WI (WSAU) — A 27-year-old Waupaca man is accused of driving high with a child in his vehicle.
The Wisconsin State Patrol says Avry A. Phelan was stopped for a moving violation on Sunday, November 30th. Officers smelled marijuana coming from the vehicle and noticed signs of impairment coming from Phelan. He then failed a field sobriety test.
He was arrested on suspicion of a second-offense OWI, a misdemeanor, and felony bail jumping, and a misdemeanor for possession of THC. Phelan signed a $2,000 signature bond following a court hearing on Monday, and is due to return for an adjourned initial appearance next Tuesday, December 9th.
Court records show he is also facing unrelated charges for false imprisonment and battery in a domestic abuse setting. In 2020, he was convicted of recklessly endangering safety and served probation.
