Javarius Hurd
MERRILL, WI (WSAU) — A phase two trial date has been tentatively set for the Madison teen responsible for the death of correctional officer Corey Proulx in the spring of 2024.
Javarius Hurd will go to trial beginning October 21st, if all goes as planned. Both sides will submit briefs and responses over the next two months, with the court to schedule a decision sometime in May.
Hurd has pled guilty by mental disease or defect to one count of second-degree reckless homicide. He also pleaded guilty to one count of battery by prisoners. The phase two trial will focus on his mental state at the time of the incident.
His defense team unsuccessfully tried to have the case transferred to the juvenile system. Hurd, who was 16 at the time of the attack, but due to the nature of the crime, the case has remained in the adult system.
A previously scheduled phase two trial was wiped from the calendar when the court couldn’t find enough potential jurors. The court plans to send about 400 jury questionnaires to find an unbiased pool.
Further court appearances are scheduled for April 29th.
Another teen, Rian Nybloom, is serving prison time for his role in the attack. He provided Hurd with a cup of soapy water, which he threw in the face of another correctional officer before beating her and running away. Proulx gave chase and attempted to restrain Hurd, who lashed out, knocking him to the ground. Proulx hit his head on a hard surface and died at a nearby hospital.
