Javarius Hurd
MERRILL, WI (WSAU) — A Lincoln County judge has denied a request to move the reckless homicide trial against Javairus Hurd out of Lincoln County.
Court records show that Judge Galen Bayne-Allison denied the motion to relocate the trial on Monday. However, he indicated the case could be moved if responses to the jury questionnaire indicate a neutral panel cannot be assembled.
Hurd, now 17, was 16 years old when he was accused of killing Corey Proulx in the outdoor recreation area of the Lincoln Hills Youth Prison in Irma. Security camera footage shows Prioulx trying to restrain Hurd, who fought back. Proulx then fell and hit his head on a hard surface. He was rushed to a local hospital, where he died a few hours later.
The incident happened after Hurd allegedly took a cup of soapy water and threw it in the face of another correctional officer. Investigators believe he planned that attack because he felt she was treating him unfairly.
Despite his age, the case is being handled in adult court. An accomplice, Rian Nyblom, is serving five years in prison as part of a plea deal for two counts of battery by prisoners. He provided Hurd with the cup of soap.
Further court action is scheduled for January 9th. A three-week trial begins on February 2nd. Hurd faces more than 40 years in prison if found guilty.
